These Terms of Service (the “Terms”) are an agreement between you and MyTechOps Ltd, trading as e-Passage (“e-Passage”, “we”, “us”). They apply when you visit our website, create an account, use the e-Passage app, or buy a subscription (together, the “Service”).
Please read them carefully. They include important limits on what the Service is, what we are responsible for, and how disputes are resolved. Our Privacy Policy, Acceptable Use Policy, Cookie Policy, Refund Policy and Disclaimer form part of these Terms. If you use an organisation workspace, our Organisation Terms also apply.
1.Who we are and accepting these Terms#
In short: By using e-Passage, you agree to these Terms. If you don’t agree, please don’t use the Service.
e-Passage is an online platform that helps people understand immigration and travel requirements, organise their information, prepare application forms, and connect with independently licensed immigration legal advisors.
You accept these Terms when you create an account, sign in, or otherwise use the Service. If you use e-Passage on behalf of an organisation (for example, in an organisation workspace), you confirm that you are authorised to accept these Terms for that organisation, and “you” includes the organisation. An order form or written agreement may add to or change these Terms for that organisation; if they conflict, the signed agreement applies.
2.Who can use e-Passage and your account#
In short: You must be 18 or older to hold an account. Younger family members can be included only by a parent or legal guardian.
- You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account and accept these Terms.
- A parent or legal guardian may add information about a child to their own account (for example, on a Family plan). The parent or guardian is responsible for that information and for any use of the Service on the child’s behalf.
- You must give us accurate information when you sign up and keep your email address up to date, because we use it to sign you in and to contact you about your account.
- One person per account. Don’t share your account or let anyone else sign in as you.
3.What the Service is, and what it is not#
In short: e-Passage gives you information, estimates and preparation tools. It is not a law firm, it does not give legal advice, it is not connected to any government, and no one can guarantee an immigration outcome.
The Service includes tools that:
- compare the profile you build with published requirements for visas and immigration pathways;
- show visa requirement checks based on nationality and destination;
- highlight items that appear to be missing against those published requirements;
- fill in application forms using the information you provide; and
- help you find and contact independently licensed immigration legal advisors.
And what it is not:
- Not legal advice. Our website and automated tools do not give legal advice and do not create a legal advisor–client relationship with e-Passage. Legal advice is given only by licensed legal advisors who engage with you directly.
- Not a law firm or immigration consultancy. e-Passage does not practise law and does not represent you before any authority.
- Not a government service. e-Passage is not affiliated with, endorsed by, or acting for any government, embassy, consulate or immigration authority. We do not submit applications on your behalf.
- Not a promise of any result. Governments make all immigration and entry decisions. Nothing in the Service is a guarantee, and we do not guarantee that any application will be accepted, approved or processed within any time.
4.Scores, estimates and missing items#
Scores, readiness indicators, “missing” items and similar outputs are automated estimates. They are calculated from the information you give us and from our reading of published criteria. They are not a decision, an assessment by an official, or a prediction of approval.
- An estimate is only as accurate as the information you enter. Incomplete or incorrect answers produce misleading results.
- Officials often apply discretion and may consider factors our tools don’t capture. A high score does not mean an application will succeed, and a low score does not mean it will fail.
- Before relying on an estimate to make an important decision, such as resigning from a job, selling property or travelling, check it with the official source and with a licensed legal advisor.
5.Requirements information and official sources#
We research visa and pathway requirements from official government sources and show the source and the date we last checked it. Information is marked as unverified until a licensed legal advisor has reviewed it.
Immigration rules, fees, forms and processing practices change often and sometimes without notice. Despite our efforts, the information in the Service may be incomplete, out of date or wrong. If anything in e-Passage differs from the official source, the official source applies. Always check current requirements with the relevant authority before you apply or travel.
Visa requirement checks for travel are general information. Airlines, border officers and other authorities decide whether you may board or enter, and may ask for documents we don’t mention.
6.Forms and the information you submit#
Form filling copies the information you provide into the relevant fields. Where a question needs judgement, we flag it for you to decide or to discuss with a legal advisor. You remain responsible for:
- making sure every answer and document is true, complete and current;
- reviewing each form before you sign or submit it; and
- submitting your application and paying any government fees yourself, through the official channel.
Giving false or misleading information to immigration authorities can have serious consequences, including refusal and bans on future applications. Never use e-Passage to prepare information you know is false.
7.AI-generated travel suggestions#
Subscribers can request optional suggestions of tourist attractions and places to visit. These suggestions are generated automatically by an AI model provided by a third party (currently Anthropic’s Claude), using only the limited trip details described in our Privacy Policy.
- AI-generated content may be inaccurate, incomplete, out of date or unsuitable for you. It is not reviewed by a person before you see it.
- Suggestions are for inspiration only. They are not travel, safety, health or immigration information, and they don’t change what any visa or entry rule requires.
- Check opening times, prices, accessibility, safety advice and entry rules with official and reliable sources before you rely on a suggestion.
- We are not responsible for places, businesses or activities mentioned in a suggestion.
This feature is available only on paid plans, and we may change or withdraw it.
8.Independent legal advisors on e-Passage#
In short: Legal advisors on e-Passage are independent. If you hire one, your agreement is with them, not with us.
- Legal advisors and other licensed advisers listed on e-Passage are independent professionals. They are not our employees, agents or partners, and we do not direct or supervise their advice.
- If you engage a legal advisor, you contract with that legal advisor directly. The legal advisor sets the scope, fees and terms of the engagement, and is responsible for the advice and services they provide. e-Passage is not a party to that engagement.
- e-Passage introduces you to a legal advisor and lets you message and share your profile with them. You arrange services, contracts and payment directly with the advisor, outside e-Passage. We don’t take payment for legal services or a share of the advisor’s fees. Any price estimate an advisor shares on e-Passage is for information only.
- We check each legal advisor’s licence against the public register of their regulator when they join and at intervals after that. These checks have limits: they rely on registers and declarations that may be out of date, and they are not an endorsement of any legal advisor’s skill or the quality of their work. You may want to check a legal advisor’s standing with their regulator yourself.
- We share your information with a legal advisor only when you choose to, as described in our Privacy Policy.
- Complaints about a legal advisor’s professional conduct should go to the legal advisor and, if needed, their regulator. Please also tell us at [email protected] so we can review whether the legal advisor should remain on the platform.
Legal advisors using e-Passage are also bound by our Legal advisor Terms.
9.Subscriptions, billing and cancellation#
In short: Plans renew automatically until you cancel. You can cancel at any time, and you keep access until the end of the period you’ve paid for.
Plans and prices
e-Passage is offered on paid plans: Individual and Family (billed monthly or yearly), organisation workspaces (client credits bought per client, or the Small team or Monthly plan) and the legal advisor plan. You can also buy one-off application packs. Prices are shown on our pricing page and at checkout in the currency for where you are (Canadian dollars, US dollars, euros, pounds sterling, naira, Indian or Pakistani rupees, Kenyan shillings, Ghanaian cedis, Philippine pesos or Bangladeshi taka). Where Stripe can’t take payment in your currency (currently Ghanaian cedis), the price is shown in it and you are charged the equivalent in US dollars, shown at checkout before you pay. Prices include any sales tax, VAT or GST that applies: what you see is what you pay. Government fees, biometrics fees, translation costs and legal advisors’ fees are never included in our prices.
Payment
Card payments for plans, application packs and organisation purchases are processed by Stripe, which sells them on our behalf as merchant of record (“sold through Link”). Your receipt and card statement will show Link. By subscribing, you authorise Stripe to charge your chosen payment method for each billing period. We don’t receive or store your full card number. If a payment fails, it may be retried and we may pause paid features until payment is made.
Renewal
Subscriptions renew automatically at the end of each monthly or yearly period at the price then in effect, until you cancel. We’ll remind you before a yearly plan renews.
Cancellation
You can cancel at any time in your account settings or by contacting us. Cancellation takes effect at the end of your current billing period; you keep access until then and won’t be charged again. Cancelling does not delete your account or your data; you can export or delete them separately.
Refunds
When and how you can get a refund is set out in our Refund Policy. Apart from what it and the law say, we don’t give refunds or credits for partly used periods. If the law where you live gives you a right to cancel and receive a refund within a set period, nothing in these Terms limits that right.
Price changes
We may change our prices. We’ll tell you at least 30 days before a new price applies to your subscription, and the change will take effect from your next renewal. If you don’t want to pay the new price, you can cancel before it applies.
Organisations
Organisation workspaces are also governed by our Organisation Terms, and may be subject to an order form or written agreement that sets out the number of clients, price, invoicing and term. The organisation is responsible for its users and for having the right to add its clients’ information to e-Passage.
10.Your content and our licence to use it#
“Your content” means the information, documents and messages you add to e-Passage, including your profile and any information about family members. You keep ownership of your content.
You give us a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content only as needed to provide, secure and improve the Service for you, to share it with people you choose (such as a legal advisor you engage), and to comply with the law. This licence ends when your content is deleted, except for copies we must keep by law or that remain in backups for a limited time, as described in our Privacy Policy. We never sell your content.
You confirm that you have the right to add your content, including any information about other people (for example, family members), and that doing so doesn’t break any law or anyone else’s rights.
11.Acceptable use#
You must use the Service lawfully and in line with our Acceptable Use Policy. In short: don’t use e-Passage to deceive authorities or other people, don’t access data that isn’t yours, don’t interfere with the Service, and don’t misuse other people’s information.
12.Keeping your account secure#
We don’t use passwords. You sign in with a one-time code sent to your email address, or with Google. Your account is only as secure as your email and Google accounts, so please protect them.
- Don’t share your sign-in codes or backup codes with anyone. We will never ask you for them.
- We strongly encourage you to turn on two-step verification with an authenticator app, and to store your backup codes safely.
- Tell us straight away at [email protected] if you think someone else has accessed your account. You can also sign out of all devices in your settings.
You are responsible for activity on your account unless it results from our failure to take reasonable security measures.
13.Third-party services and links#
The Service links to, and works with, services run by others, such as government websites, Google sign-in and our payment processor. We don’t control those services and aren’t responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.
14.Our intellectual property#
The Service, including our software, design, text, compilations of requirements, scoring methods, logos and the e-Passage name, belongs to us or our licensors and is protected by law. Government materials we link to or quote remain subject to their own terms.
We give you a personal, non-transferable, revocable right to use the Service for its intended purpose while you follow these Terms. You may not copy, scrape, resell or create competing products from the Service or its data, or remove any notices from it.
If you send us feedback or suggestions, we may use them without obligation to you.
15.Suspension and termination#
You can stop using e-Passage and delete your account at any time from your settings. We’ll ask you to confirm by email before we delete it.
We may suspend or close your account, or limit access to features, if you seriously or repeatedly break these Terms, if we must do so by law, or if your use puts other users, legal advisors or the Service at risk. Where reasonable, we’ll tell you why and give you a chance to fix the problem first, and we’ll give you an opportunity to export your data unless the law or a security risk prevents it. If we close your account without cause, we’ll refund any prepaid amount for the unused period.
Sections that by their nature should continue after termination (including ownership, disclaimers, limitation of liability, indemnity and governing law) continue to apply.
16.Disclaimers#
To the extent the law allows, the Service is provided “as is” and “as available”. We do not make any promise, express or implied, that the Service will be uninterrupted, error-free, or that its information is complete, accurate or current, and we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not guarantee any immigration, visa, travel or entry outcome, or any processing time. More detail is in our Disclaimer.
Some jurisdictions don’t allow certain warranties to be excluded. In those places, these exclusions apply only as far as allowed.
17.Limitation of liability#
To the extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, opportunities, data or goodwill, arising from your use of the Service.
- We are not liable for decisions made by any government or authority, for the advice or services of any legal advisor you engage, or for actions you take based on estimates or information in the Service.
- Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or CAD 100.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence or wilful misconduct, or your rights under consumer protection laws that apply to you.
18.Indemnity#
To the extent the law allows, you agree to compensate us for reasonable losses and costs (including reasonable legal fees) arising from claims by third parties caused by your breach of these Terms, your misuse of the Service, or content you add that you didn’t have the right to add. This doesn’t apply to the extent a loss was caused by us. If you are a consumer, this section applies only as far as the consumer protection laws where you live permit.
19.Governing law and disputes#
These Terms are governed by the laws of Canada and of the province in which MyTechOps Ltd is registered, without regard to conflict-of-laws rules. The courts of that province have jurisdiction over disputes, unless the law where you live gives you the right to bring a claim in your local courts.
If you have a concern, please contact us first at [email protected]. Most issues can be resolved quickly and informally.
If you are a consumer, you keep any protections given to you by the mandatory laws of the country or province where you live.
20.Changes to these Terms#
We may update these Terms as the Service or the law changes. We’ll update the date at the top of this page and, for significant changes, tell you by email or in the app at least 30 days before they take effect. If you keep using the Service after the changes take effect, the updated Terms apply. If you don’t agree, you can cancel and delete your account before then.
21.General#
- These Terms and the documents they refer to are the whole agreement between you and us about the Service.
- If a court finds part of these Terms unenforceable, the rest stays in effect.
- If we don’t enforce a right straight away, we haven’t given it up.
- You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets, and will tell you if that happens.
- These Terms are written in English. If we provide a translation and it conflicts with the English version, the English version applies, unless the law requires otherwise.
