E-2 Treaty Investor
The E-2 lets a national of a country that has a qualifying treaty with the US live and work in the US to develop and direct a business in which they have invested, or are actively investing, a substantial amount of capital. Key employees of the same nationality can also come. There is no fixed minimum investment; the amount must be substantial relative to the cost of the business, at risk, and the business must be a real, operating, non-marginal enterprise. Applicants abroad apply for a visa at a US consulate; people in the US in another lawful status can change status through Form I-129. The related E-1 treaty trader classification is covered in the separate US.E1 record.
